Setting the Scene: Why the focus on Brazil gaming now?
The new legislation for Brazil’s online gaming enables operators to apply for five-year licences — each subject to a high upfront fee of up to R$30m (approx. US$5.88m). It also establishes a series of other statutory requirements, such as obligations for operators to use facial recognition technologies in ID verification and prohibiting diagnosed gambling addicts from being able to access online betting platforms. Since the enactment of Law No. 14.790, the Ministry of Finance’s Secretariat of Prizes and Bets (SPA) has been tasked with enacting secondary regulations via a series of ordinances to regulate fixed-odds betting and establish the Brazilian licensing regime. After some initial delays and a search for a head regulator, the SPA announced a four-phase rollout of 11 ordinances in April 2024 to regulate fixed-odds betting via Ordinance No. 561/2024. Additionally, the SPA has published a FAQ page for fixed-odds betting.

The purpose of this report is to follow the release of each of the 11 implementing ordinances listed in Ordinance No. 561/2024 and provide a breakdown of each of the regulations. As of August 2024, all ordinances have been released. This report is now up to date with details on those releases.
